CONDUCTING A FEASIBILITY STUDY FOR THE PROJECT “Empowered women garment workers: Joint engagement of civil society, companies and governments for improved respect for the rights of women in the Mekong region”

CARE International, within the development of the project proposal: “EMPOWERED WOMEN GARMENT WORKERS: JOINT ENGAGEMENT OF CIVIL SOCIETY, COMPANIES AND GOVERNMENTS FOR IMPROVED WORKING CONDITIONS IN THE RECOVERY FROM COVID-19 PANDEMIC IN THE MEKONG REGION”, is looking to contract an external consultancy (consultant team or a consultancy company) for undertaking the Feasibility Study (F/S) is to deliver sufficient information and data on the prospects for a successful implementation of the planned action - joint engagement of CSOs, private sector and governments to improve respect for the rights of women working in the garment industry in Cambodia, Vietnam and Laos. The F/S should be led by an international consultant with national consultants in each country that do the data collection.

CARE has more than 20 years of experience working with the garment sector in the Mekong region and implements the “Made by Women” strategy in this region to ensure women in the garment industry have access to decent jobs, are free from violence and harassment and can give voice to their rights at work. Made by Women’s goal is 1) to empower women garment workers by supporting them to know their rights, build group solidarity and work collectively to engage in dialogue and advocate to power holders; 2) to strengthening the legal and social protection of worker’s human rights by governments and 3) to promoting respect for worker’s human rights by businesses in the supply chain.Project information

The project “Empowered women garment workers: Joint engagement of civil society, companies and governments for improved respect for the rights of women in the Mekong region”, will support and empower civil society to strengthen the social accountability of business actors to workers and their organisations in the garment industry in order to increase social protection of women garment workers. The goal of the project is to strengthen the ability of civil society to improve respect for the rights of women working in the garment industry through advocacy, dialogue and negotiation with duty bearers, particularly employers and the government departments which regulate businesses practice and monitor compliance with the law and to improving the engagement and responsiveness of duty-bearers to the concerns and demands of workers and their organizations.

The following project outputs are expected:

Output 1: Women workers and their organisations have increased capacity to hold employers and governments accountable for the rights of women working in the garment industry

Output 2: Garment industry duty bearers demonstrate improved commitment and take action to improve respect for the rights of women working in the garment industry

Output 3: Gender just policies, legal frameworks and government capacity are strengthened to improve respect for the rights of women working in the garment industry

Target groups & final beneficiaries:**

The action directly targets CSOs which will conduct capacity development of women work leaders, worker organisations, whose capacity and knowledge on rights of women working in the garment industry will be increased, private sector representatives who participate in multi stakeholder forums and governmental institutions which will be supported in the improvement of legal frameworks for women garment workers in Vietnam, Cambodia and Laos. Final beneficiaries of the action will be women garment workers in targeted locations in Vietnam, Cambodia and Laos. They will benefit from the stronger representation of interests by peers and workers organisations and their achievements for the entire workforce. The women work leaders will identify main barriers to granting rights of women working in the garment industry and address those towards private sector and governmental institutions which creates ownership and ensures their commitment.

Purpose and objectives of the F/S:

Purpose of this consultancy is to provide the sound basis for developing of the project concept, by identifying project preconditions, opportunities and risks for its implementation.

In overall, the F/S will have the following objectives:

1) Given context, needs of target group and stakeholders in targeted areas in Vietnam Cambodia and Laos

· Identify the needs of the target group (right breaches garment workers are exposed, capacity needs for participation) regarding the project objectives and the type of interventions and services most needed (and feasible) in the coming period, regarding the socio-economic strengthening of the female garment workers

· Picture the social and economic environment of the target group in Vietnam, Cambodia and Laos by considering political, economic and cultural context aspects and providing an in-depth analysis of the situation of women garment and LGBTQ+workers.

  • Mapping relevant worker and CSO organisations and networks and their existing capacity regarding a) representation of workers, b) gender and social protection and c) ability to promote social accountability of duty bearers in form of a capacity assessment (describing background of organisation, experience in relevant thematic fields, their strategies and priorities; and the forms of support and opportunities these organizations identify

· Identify private sector networks and initiatives in Vietnam, Cambodia and Laos for direct engagement with factories under output 2 and describe their background, field of expertise, strengths and weaknesses and identify those with the biggest scope for change

· Identify legal framework and services (current policy framework, standards, local policies, guidelines and practices) and related gaps in the implementation in the field of economic empowerment and social protection for the above mentioned target groups, and participation of key stakeholders (governmental, non-profit, and private) in the three targeted countries and regional level. CARE will provide the consultant team with governmental policies and strategies considered as most relevant and that may represent opportunities to influence and impact. In addition to that the consultant team should identify new policy windows for engagement.

· Explore work streams of the Partnership for Sustainable Textiles (PST) https://www.textilbuendnis.com/en/ and interview global brands represented in the PST to identify areas of alignment

  • Identify the existence of similar projects or intervention in the region conducted by other stakeholder for alignment and synergies. Analyse lessons learnt from these in the past and gaps still present today.

2) Feasibility

· Can the planned project confirm the identified structural gaps in the respect for the rights of women working in the garment industry? Can the planned project close this gap sustainably, effectively, coherently and efficiently with the resources and measures?

· Formulate clear recommendations for the design of the Action (objective, output, activities)

Scope of work

The consultant team is required to conduct feasibility appraisals of the proposed project. The scope of work will include:

· Review of existing data available for project intervention, on the potential for improvement of socio-economic prospective of women garment workers;

· Conduct appropriate site background information gathering on potential CSOs/workers organisations, similar activities and priorities of PST member organisations, platforms to involve business actors in target countries, relevant ministries as well as gaps and needs for women garment workers.

· Identify examples of and recommendations from earlier similar initiatives and other studies being implemented in the relevant locations;

· Conduct consultations with CSOs/workers organisations and women garment workers to assess the relevance of the proposed interventions;

· Outline realistic time line for the proposed set of activities;

· Identify the barriers, challenges or any critical issue – if any - that could determine the effectiveness, efficiency and sustainability of the project;

Methodology of the F/S.

The F/S should be written in high quality English and satisfy the above stated purpose and objectives. Within the F/S design, the consultant will refer to and follow the document Guidance Note on Procedures for Feasibility Studies which, as Appendix A, represents an integral part of this ToR.

The F/S should represent a combination of desk analysis and field research, which should concentrate on Laos (Vientiane), Cambodia (Phnom Penh and immediate surrounding districts in Kandal province) and Vietnam (Dong Nai Province) and the German Partnership for Sustainable Textiles (Germany). The selected consultant(s) should review available data and information on national level, consider relevant background information (legislation, strategies), identify relevant similar initiatives for possible programmatic synergy, review the potential for joint engagement of CSOs, private sector and governments to prevent and remediate the adverse impacts of business practices and the COVID-19 pandemic for female garment workers in Cambodia, Vietnam and Laos; analyse potential risks with regards to the proposed projects and propose mitigation measures. The field research should bring in the attitudes of relevant stakeholders, needs and capacities of potential beneficiaries, sustainability concerns and recommendations:

· Analysis of studies, organization reports, documentation, resource persons/experts, and similar;

· A review of existing laws, policies, strategies, statistics and reports related to the situation of women and LGTBQ+ garment workers in the targeted countries

· Interviews/ focus group discussions and/or questionnaires with CSOs, workers organisations, business associations, representatives of the business sector and public institutions, dealing with the final beneficiaries and with decent work and social protection issues;

  • Evaluations and reports of garment sector projects
  • Legal framework and policy documents
  • Draft logframe
  • Relevant Contacts in the targeted countries and the PST available to CARE
  • Organisational capacity assessments and organisational capacity assessment form
  • Strategies and information on CSO organisations and other stakeholders

Consultancy deliverables

· Plan for implementation of the Feasibility Study.

· F/S Report written in English (up to 30 pages). The Report should consist of an executive summary (up to 2 pages), main Study findings, recommendations for planning and implementation of particular project activities (up to 4 pages) and references, plus eventual Annexes (capacity assessment of CSO organisations).

· Hand over to CARE the entire original quantitative and qualitative data documentation collected for the purposes of the research/needs assessment, upon the final consultancy report acceptance and prior to the payment.

Timeframe

The entire assignment, including the period of final adjustment of the report and acceptance by CARE is expected to be undertaken over the period 8th March- 31st March 2021. The individual and/or company undertaking the consultancy will be fully responsible to administer the F/S. The final product shall be delivered to CARE Deutschland e.V. Desk Officer Southeast Asia by 5th April 2021

Management and organization

The Consultant/Company will report directly to Joe Sutcliffe, Senior Advisor Dignified Work (Sutcliffe@careinternational.org) and Katrin von der Dellen, Desk Officer Southeast Asia (v.d.dellen@care.de).

Skills and qualification of the experts

The following qualifications are required for this task:

· Socio-economic science background, ideally with a focus on garment sector, or similar relevant field expert with rich experience and qualifications in conducting feasibility studies, assessments and evaluations in the Mekong area.

· Preferably knowledge of the Partnership of Sustainable Textiles

· Adequate experience in qualitative and quantitative data collection methods.

· Excellent understanding of and knowledge on the issues of women garment workers.

· Excellent knowledge of the stakeholders in the garment industry.

· Excellent English writing skills. Capable to systemise data and write high quality, clear, concise reports.

The consultant’s proposal should consist of the following:

  1. Consultant’s CV (or organisational/company portfolio, with individual researchers’ CVs) with detailed information concerning past experience in the field of consultation, research and evaluation, as well as the list of references on the conducted consultations.

  2. The Consultancy Proposal, which should be clear and concise with goals and objectives for the task as well as described proposed working methodology and plan and a timeline.

  3. Consultant’s Budget. Global price budget that includes all expenses (including travel) should be proposed.

  4. Consultant’s availability and commitment to schedule statement.

Appendix A: Guidance Note on Procedures for Feasibility Studies:

**

I) Criteria for the content of feasibility studies

• The focus, scope and depth of a feasibility study should be appropriate to the complexity and volume of the project in question and consider the political, economic and cultural context.

• The study should analyze the situation, the problem(s) resulting thereof and the target group and stakeholders. It should include a baseline study (for instance as an annex), and critically review the planned project in terms of the OECD/DAC criteria of relevance, coherence, effectiveness, efficiency, impact and sustainability (see https://www.oecd.org/development/evaluation/daccriteriaforevaluatingdevelopmentassistance.htm )

• On that basis, the study should provide recommendations for the project concept and project measures.
